Terms specific to Partners listing and selling on Pitchd.

This is the complete, definitive source of the commercial and payment terms governing your participation as a Supplier — including fees, payouts, subscriptions, GST treatment, and refund and chargeback recovery. Together with the Terms of Service and our other incorporated policies, it forms the complete legal framework between you and Pitchd. You accept it electronically when you approve your Custom Storefront during onboarding.
Pitchd primarily operates as a package-driven marketplace where Suppliers build complete, purchasable experiences using Packages, Options and Add-ons that Consumers can discover, compare, and book directly without enquiry or negotiation. This is the core model of the platform.
Pitchd operates a managed onboarding model. Unlike traditional marketplaces that require Suppliers to build their own profiles, Pitchd builds and manages your Custom Storefront on your behalf — at no cost. You provide the information. We structure it into a professional, searchable and bookable online storefront. Each Supplier receives a dedicated Custom Storefront featuring their own branding, Packages, Add-ons, reviews, gallery, verification status and booking experience.
Your relationship with Pitchd is that of an independent contractor. You are not an employee, agent, partner, or joint venturer of Pitchd. Pitchd does not direct or control how you deliver your services. You have complete discretion over how you provide your services, at what price, and on what terms, subject to this Agreement and the Terms of Service.
There is no exclusivity arrangement between you and Pitchd. You are free to maintain your own website, accept direct bookings, advertise elsewhere, and list your services on other platforms. Pitchd is similarly free to onboard other suppliers within the same category, region, or service area.
Suppliers join the Pitchd platform by expressing interest through a short online form, an onboarding call with the Pitchd team, or a direct invitation from Pitchd. By expressing interest, you authorise Pitchd to collect your business information and begin building a Custom Storefront for your business on the Pitchd platform.
Using the business information you provide, the Pitchd team builds your Custom Storefront. This includes:
Custom Storefront descriptions, layouts, package structures, category mapping, and other content created by Pitchd during the onboarding process remain the intellectual property of Pitchd. You retain ownership of original photos, logos, and materials you upload or provide.
Pitchd may edit your listing, Packages, descriptions and other content within your Custom Storefront — including photos, package structure and layout — to improve Consumer experience, consistency, readability, search performance or platform standards. Pitchd will not materially misrepresent your services in doing so.
Once your Custom Storefront is built, Pitchd provides you with a preview so you can review your packages, pricing, and content before anything is made visible to Consumers. You may request changes to your preview through your supplier dashboard or by contacting Pitchd support, and Pitchd will update your Custom Storefront accordingly. You must review your Custom Storefront carefully and confirm that all information is accurate, complete, and consistent with your actual services and pricing before proceeding to approval.
Once you are satisfied with your Custom Storefront, you approve it electronically through your Pitchd account. Approving your Custom Storefront is also the point at which you electronically accept this Agreement, the Terms of Service, the Privacy Policy, and all other incorporated policies. You do not need to sign or return a physical copy of any of these documents — your electronic approval and acceptance is binding.
By approving your Custom Storefront and electronically accepting this Agreement, you confirm that:
The individual electronically accepting this Agreement warrants that they are authorised to accept this Agreement on behalf of the Supplier and to bind the Supplier to its terms. Where the Supplier is a company, partnership, trust, or other entity, the individual accepting on the entity's behalf represents that they hold the necessary authority — for example, as a director, owner, partner, or authorised employee — to do so.
Pitchd retains a record of your acceptance of this Agreement and the incorporated policies, including your Supplier ID, legal business name, trading name, ABN, the authorised representative who accepted on your behalf, the version of this Agreement accepted, the date and time of acceptance, the IP address from which acceptance was made, and confirmation of acceptance of each incorporated policy. These records constitute evidence that this Agreement has been accepted and are retained in accordance with the Privacy Policy and applicable law.
Electronically accepting this Agreement and the incorporated policies authorises Pitchd to publish your Custom Storefront — it does not itself cause immediate publication. Before your Custom Storefront becomes eligible for public discovery, Pitchd must verify your compliance documents and give final approval. Public discovery of approved Custom Storefronts is also subject to a separate, platform-wide setting controlled by Pitchd; Booking Requests may be independently enabled or disabled by Pitchd for operational reasons. After your Custom Storefront is live, you may request further changes at any time through your supplier dashboard or by contacting Pitchd support. Pitchd reserves the right to review and approve requested changes before publication to maintain platform quality and consistency, and aims to process change requests within a reasonable timeframe.
You are responsible for notifying Pitchd of any material changes to your services, pricing, packages, availability, or compliance documents as soon as reasonably practicable. Where a change affects your compliance status — including insurance cancellation, licence suspension, or business closure — you must notify Pitchd immediately. For other material changes, notification should occur as soon as possible and generally within 14 days. Pitchd may update your Custom Storefront on your behalf where required to keep it accurate. Maintaining an inaccurate Custom Storefront is a breach of this Agreement.
Pitchd may permit you to manage multiple linked Custom Storefronts under a single account and login — for example, where you operate several distinct businesses or brands. This allows businesses operating multiple brands or service types to maintain separate customer-facing storefronts while managing them from a single account. During the Founding Partner Program, each linked Custom Storefront receives its own full package allowance for its plan — a Founding Partner on Free with three linked Custom Storefronts has three separate 5-package allowances, not one shared allowance. Once the Founding Partner Program ends, Pitchd intends to move to a discounted subscription rate for a Supplier's second or subsequent linked Custom Storefront rather than a full-price subscription per storefront; exact discounted pricing is not yet set. Each linked Custom Storefront is treated as a separate Listing for the purposes of this Agreement and the Terms of Service, is subject to the same verification, compliance, and electronic acceptance requirements, and generates its own Agreement Records.
Where a compliance document genuinely applies to the Supplier's business as a whole and covers multiple linked Custom Storefronts, it does not need to be independently uploaded for each linked Custom Storefront. Where a compliance document, licence, registration, permit, certification or check applies only to a particular service, activity, location, vehicle, personnel or Custom Storefront, the Supplier must provide and maintain that compliance information separately for each linked Custom Storefront to which it applies. Pitchd may determine whether a compliance document satisfies the requirements of one or more linked Custom Storefronts as part of its verification process.
No Supplier may accept bookings on the Pitchd platform until they have been verified. Verification means Pitchd has reviewed and confirmed all compliance documents required for your service category. The verified badge on your Custom Storefront confirms your documents have been reviewed. It does not guarantee that your coverage is adequate for every specific circumstance.
The compliance documents required vary by service category. All Suppliers must provide:
Additional requirements apply by category. The full list of category-specific compliance requirements is published on the Supplier Compliance Requirements page on the Pitchd platform and is incorporated into this Agreement by reference. Category-specific requirements include but are not limited to:

This table is illustrative and not exhaustive. Pitchd reserves the right to update compliance requirements at any time in response to changes in applicable law or industry standards. You will be notified of changes and given reasonable time to comply.
Compliance is an ongoing obligation, not a one-time requirement. You must maintain all required compliance documents in current and valid status at all times while listed on the Pitchd platform. Pitchd monitors compliance document expiry dates and will send you automated reminders before documents expire. It is your responsibility to renew documents before they expire and to upload renewed documentation promptly.
You must notify Pitchd immediately if any compliance document lapses, is cancelled, is suspended, falls below the required standard, or is subject to any investigation, complaint, or regulatory action. Failure to notify Pitchd of a compliance issue is a material breach of this Agreement.
Maintaining valid public liability insurance at the level required for your service category is a non-negotiable requirement of your participation on the Pitchd platform. Insurance requirements are risk-based and category-specific. Pitchd reserves the right to set and update insurance requirements for different Supplier categories and service types in accordance with applicable law, industry standards, and platform risk management. If your insurance lapses for any reason:
Pitchd does not provide insurance coverage for Suppliers and accepts no responsibility for your failure to maintain adequate insurance. You indemnify Pitchd against any claims, losses, damages, costs, or liabilities — including legal costs — arising directly or indirectly from your failure to maintain the required insurance coverage at any time during your participation on the platform.
Providing false or misleading information about your compliance status — whether at onboarding, in your Custom Storefront, or at any subsequent time — is a serious breach of this Agreement and the Terms of Service. Pitchd may immediately suspend or permanently remove any Supplier found to have misrepresented their compliance status and may refer the matter to relevant authorities.
You warrant that all information you provide to Pitchd — including but not limited to your compliance status, insurance coverage, licences, qualifications and the accuracy of your Listing — is true, accurate and not misleading, at the time it is provided and for as long as it remains displayed on the platform. You acknowledge that Pitchd, Consumers, and other third parties reasonably rely on that information, including in publishing your Listing, approving your verification status, and making booking decisions. This warranty is directly relied upon in the indemnity at Section 11.
Every service you offer on Pitchd must be structured into one or more Packages with a clearly defined, fixed pricing model. Depending on the service offered, a Package may be priced as a flat price, or on a per person, per hour, per day, per session, per ticket, per vehicle, or other fixed pricing unit supported by the platform. Whatever the pricing unit, the price itself must be fixed and transparent — Pitchd does not support open-ended, quote-based, or "contact for pricing" listings. Each Package must have a clear name, the applicable fixed price and pricing unit, a defined set of inclusions, a duration, and a maximum guest capacity where applicable. Vague or open-ended packages that do not give Consumers a clear understanding of what they are booking and what it costs are not permitted.
You may offer optional or mandatory Add-ons alongside each Package, including Add-on Options — variations such as flavour or size within a single Add-on. Add-ons allow Consumers to extend or customise their booking without creating complexity. Each Add-on must have a clear name, a fixed price, and a clear description of what it includes. Packages and Add-ons may also contain structured Options or Option Sets where Consumers choose between variations — for example, a Package where booth style is one Option Set and a complimentary theme is a separate, $0 Option Set. You must structure pricing so that a free or included configuration choice never affects or reduces your Package's displayed starting price. The Booking Success Fee applies to the Total Booking Value including all Add-ons and paid Options selected or required at checkout.
The prices displayed on your Custom Storefront are the prices Consumers will pay. You must honour the Quoted Price of every Package and Add-on for all bookings confirmed at that price. You may update your pricing at any time through your supplier dashboard or by contacting Pitchd support, subject to Pitchd's review and approval process. Price changes do not affect bookings already confirmed at the previous price.
You may opt in to future Pitchd promotional campaigns and select a promotional contribution percentage from fixed tiers (2% / 5% / 10% / 15% / 20% / 25%) or a custom amount, through your account settings. When Pitchd runs a promotional campaign and applies a discount to your Package, the Booking Success Fee is calculated on the discounted amount — the actual amount the Consumer pays. Participation in promotional campaigns is always voluntary. No live campaign functionality exists yet — this is data-structure groundwork only.
You must enter your Package and Add-on prices inclusive of GST, where applicable — the price displayed is always the total price the Consumer pays. You indicate your GST registration status in your account settings; if you are registered for GST, your displayed price is treated as already including GST. You are responsible for determining whether GST applies to your services and for remitting GST to the Australian Taxation Office in accordance with your obligations. Pitchd does not automatically add or adjust GST on your prices.
When a Consumer submits a Booking Request for your services, Pitchd will notify you immediately by SMS and platform notification. You have 24 hours to accept or decline the request. If you do not respond within 24 hours, the request expires automatically. Repeated failure to respond to Booking Requests within the acceptance window may affect your search placement and verified status.
By accepting a Booking Request, you make a binding commitment to deliver the service as described in your listing on the agreed date, time, and location. Payment is captured from the Consumer's payment method at the time you accept the booking.
You must deliver every Confirmed Booking professionally and in accordance with your listing. This means:
Suppliers are expected to maintain professional standards at all times before, during, and after a booking. Where complaints or concerns are raised about Supplier conduct, Pitchd may investigate the matter, request information from both parties, issue a written warning, temporarily suspend the Supplier's account, or permanently remove the Supplier from the platform depending on the severity and frequency of the conduct.
Refunds arising from Supplier conduct are not automatic. They are assessed through the Pitchd dispute resolution process as set out in the Dispute Resolution Policy and Cancellation & Refund Policy. Serious misconduct — including behaviour that poses a risk to safety, involves dishonesty or fraud, or causes significant harm to a Consumer — may result in immediate suspension or removal without prior warning.
You must not cancel a Confirmed Booking without a valid reason. Valid reasons, and the platform's default cancellation and refund schedule, are set out in the Cancellation & Refund Policy. Where you have Pitchd-approved Supplier-Specific Cancellation Terms in place for a booking, those terms — not Pitchd's default schedule — govern that booking, in accordance with the Cancellation & Refund Policy. Valid reasons for cancellation include genuine illness or medical emergency, serious equipment failure, death or serious injury of an immediate family member, a Major Disruptive Event, or a government-mandated restriction that legally prevents delivery of the service. If you need to cancel for a valid reason, you must contact Pitchd support immediately — not the Consumer directly — and provide supporting documentation where possible.
Cancelling a Confirmed Booking without a valid reason is a serious breach of this Agreement. Consequences include the Consumer receiving a full refund, forfeiture of your payment for that booking, a recorded cancellation against your account, and potential suspension or removal from the platform for repeat cancellations.
Failing to appear at a Confirmed Booking without cancelling in advance is treated as a no-show and is equivalent to a cancellation without a valid reason. The Consumer will receive a full refund. Your payout for the booking is forfeited. The no-show is recorded on your account and may result in immediate suspension of your listing pending investigation. Repeated no-shows will result in permanent removal from the platform.
Search order and placement may take into account subscription level, relevance, availability, reviews, response rate, booking performance, Custom Storefront completeness, trust badges, verified status, and other platform quality signals. Pitchd may change the factors it considers or how they are weighted at any time.
This section is the definitive source of Supplier commercial and payment terms. It supersedes and replaces the Payments Terms of Service for all Supplier-facing commercial content.
Every payment on the Pitchd platform follows this sequence: the Consumer selects a Package and any Add-ons and submits a Booking Request; you have 24 hours to accept or decline; if you accept, payment is captured from the Consumer through Stripe and the booking becomes a Confirmed Booking; the booking date is automatically blocked; you deliver the service; 24 hours after the scheduled date, the booking automatically moves to Completed status unless a dispute has been raised; 2 business days later, Pitchd releases your payout, having retained the Booking Success Fee.
You are the merchant of record for the sale of your service. The Consumer is buying your service, you set the price and deliver the service, and you are responsible for GST on that sale. Pitchd provides marketplace, payment collection and technology services to you — it does not sell the service itself. The Consumer-facing tax invoice is issued in your name and shows your business name and ABN, not Pitchd's. Pitchd may generate that invoice automatically on your behalf using your ABN and GST registration status.
Pitchd charges a Booking Success Fee (BSF) on every Confirmed Booking. The BSF is calculated as a percentage of the Total Booking Value — the actual amount paid by the Consumer including all Packages and Add-ons at the final transacted price. You only pay the BSF when you receive payment. There are no listing fees, no lead fees, and no fees charged before a booking is confirmed.

The monthly fees above are the base monthly-billing price. Section 6.2a sets out the discounted price available if you choose annual billing.
Starter, Growth and Premium may be paid annually in advance, on the subscription's annual anniversary, at a discounted rate: Starter $319/year, Growth $539/year, Premium $979/year — roughly a month free compared to paying monthly. The Free plan has no paid tier and no annual option. Monthly billing remains available on all paid plans.
As a Founding Partner, you retain access to the Founding BSF rate schedule shown above for as long as you continuously remain an active Pitchd Partner. If you upgrade or downgrade between plans, the Founding BSF rate for your new plan applies — your Founding status is not tied to one fixed rate, but to ongoing access to the Founding rate schedule across all four tiers. Specifically:
Additional package slots are available only once you have reached Premium's 15-package limit — not on Free, Starter or Growth. Once on Premium and at the 15-package limit, you may purchase additional package slots for $5 per additional package, per month, on top of your Premium subscription.
The BSF and any subscription fee are charges made by Pitchd to you for marketplace services, treated as a separate transaction from your sale to the Consumer. Where applicable, GST is charged on these fees, and Pitchd issues you a tax invoice.
Example: Total Booking Value of $1,100, where you are registered for GST, on the Free plan (10% BSF). Your sale comprises $1,000 revenue and $100 GST, which you collect from the Consumer. Pitchd invoices you a Booking Success Fee of $110, comprising $100 plus $10 GST. Stripe transfers $990 to you. You account for the $100 GST collected from the Consumer, and may claim the $10 GST paid to Pitchd as an input tax credit, subject to your own tax circumstances. Pitchd accounts for the $10 GST on its fee. A Growth subscription fee of $49/month is treated the same way — $44.55 plus $4.45 GST.
You will always receive the Consumer's final transaction amount minus the applicable BSF. Pitchd will never deduct any amount beyond the applicable BSF from your payout. Where a promotional or campaign discount has been applied to a booking, your payout reflects the discounted amount the Consumer actually paid, minus the applicable BSF. Payouts are released 2 business days after a booking reaches Completed status.
Your payouts are processed through Stripe Connect. To receive payouts, you must complete the Stripe Connect onboarding process, including business bank account details, business information, and identity verification as required by Stripe. You must maintain a valid and active Stripe Connect account at all times. Pitchd cannot process payouts to Suppliers who have not completed Stripe onboarding or whose Stripe Connect account has been suspended or closed. All payouts are made in Australian Dollars (AUD) to an Australian bank account; Pitchd does not support international payouts at launch.
If your payout fails for any reason — including invalid bank details, Stripe account issues, identity verification problems, or account restrictions — Pitchd will hold the funds until you resolve the issue and will notify you of the reason. Funds held due to a failed payout are not returned to the Consumer, and a failed payout does not affect the Consumer's booking or your obligation to deliver the service.

Subscription fees are charged monthly in advance from your activation date. There is no free trial period at launch. You may upgrade at any time (effective immediately) or downgrade (effective next billing cycle). Cancellation takes effect at the end of the current billing period and moves your account to the Free plan; subscription fees are non-refundable for any unused portion except where Pitchd terminates your account without cause. If a subscription payment fails and cannot be collected after reasonable retries, your account is downgraded to Free and the 10% BSF applies until payment resumes.
Pitchd does not charge Consumers any service fee or platform fee. The price a Consumer sees is the price they pay. The BSF is charged to you as the Supplier and is not passed on to Consumers in any form. This is a fundamental commitment of the Pitchd platform and is non-negotiable.
If a refund, chargeback, or dispute outcome requires funds to be returned to a Consumer after those funds have already been released to you, Pitchd may recover the relevant amount from you by deducting it from future payouts, offsetting it against funds Pitchd holds on your behalf, charging your nominated payment method on file, or any other lawful means. Pitchd will notify you before initiating recovery and explain the amount and reason. You remain responsible for all amounts properly owed to Consumers following disputes, refunds, or chargebacks, regardless of whether you agree with the outcome.
Consumers are encouraged to contact Pitchd support before initiating a chargeback directly with their bank. If a chargeback is initiated, Pitchd will review the relevant booking records and respond on behalf of the platform. Where a chargeback results in a Consumer refund and you have already been paid, Pitchd may recover the refunded amount from you as described above.
Your supplier dashboard displays Booking Value, Booking Success Fee, and Net Payout for each booking, so you can see your net position at a glance. Pitchd intends to provide monthly statements and an end-of-financial-year report covering total booking revenue, refunds, BSF, GST on Pitchd fees, and net payouts — available as CSV export and PDF statement — so you can hand a complete record to your accountant. This is a roadmap item, not available at launch.
Pitchd reserves the right to change its subscription fees or BSF rates at any time, with at least 30 days notice before changes take effect. This right does not apply to a Founding Partner's Founding BSF rate, which is governed exclusively by Section 6.3a and cannot be varied under this Section 6.12 for as long as the Founding Partner remains eligible under 6.3a. This right does apply to: post-Founding rates for Suppliers who are not Founding Partners; the pricing of any new plan or tier Pitchd may introduce; the annual billing price under Section 6.2a; the $5 additional package slot fee under Section 6.3b; and subscription fees generally, to the extent they are not part of the Founding BSF rate itself. Fee changes will not apply to bookings already confirmed before the effective date.
You retain ownership of original photos, logos, and other materials you upload or provide to Pitchd ("Supplier Content"). By providing Supplier Content, you grant Pitchd a non-exclusive, worldwide, royalty-free licence to use, store, display, reproduce, and distribute that content for the following purposes:
This licence continues for the duration of your participation on the platform and, for content already used in marketing or promotional materials, survives your departure from the platform. You warrant that you own or have the right to grant this licence for all Supplier Content you provide and that the use of such content by Pitchd will not infringe any third party's rights.
Custom Storefront descriptions, layouts, package structures, category mapping, and other content created by Pitchd during the onboarding or ongoing management process remain the intellectual property of Pitchd. You do not acquire ownership of Pitchd-created content by virtue of your participation on the platform. You may request a copy of your Custom Storefront content at any time.
All technology, software, design, trademarks, and other intellectual property relating to the Pitchd platform are owned by or licensed to Pitchd. You must not copy, modify, reverse engineer, scrape, or otherwise exploit any part of the Pitchd platform without Pitchd's prior written consent.
Pitchd may use Supplier activity, booking data, Custom Storefront data, review data, compliance records, and other platform interactions in aggregated, anonymised, or de-identified form to:
No personally identifiable information will be disclosed in connection with these activities except as permitted by the Privacy Policy. De-identified and aggregated data does not identify any individual Supplier and is used at the platform level to improve outcomes for all Suppliers and Consumers. This clause survives the termination or expiry of this Agreement.
Suppliers who join the Pitchd platform during the launch phase may be recognised as Founding Partners. Founding Partner status acknowledges your role as an early partner in building Pitchd. Founding Partner places are limited and available only during the launch phase of the platform.

Additional benefits, promotions, or pricing incentives may be offered to Founding Partners from time to time at Pitchd's sole discretion. Any such additional benefits will be communicated in writing.
Founding Partner status does not create or imply:
Founding Partner Suppliers are subject to the same Terms of Service and Supplier Agreement as all other Suppliers on the platform.
You may request removal of your Custom Storefront from the Pitchd platform at any time by contacting Pitchd support at support@pitchd.com.au. Pitchd will process your request and remove your public Custom Storefront within a reasonable period. However, Pitchd may delay removal where any of the following exist at the time of your request:
Once all outstanding matters are resolved, Pitchd will remove your public Custom Storefront. Pitchd will retain your booking records, reviews, transaction history, compliance records, and other platform data for legal, operational, and record-keeping purposes in accordance with the Privacy Policy and applicable law.
If you leave the platform with outstanding Confirmed Bookings, you remain obligated to fulfil those bookings in accordance with this Agreement and the Terms of Service. Leaving the platform does not release you from your obligations to Consumers who have already confirmed and paid for your services. Failure to fulfil outstanding bookings on departure is treated as a cancellation without valid reason and the relevant consequences apply.
Pitchd may suspend or terminate your participation on the platform at any time for a material breach of this Agreement, the Terms of Service, or any incorporated policy. For non-serious breaches, Pitchd will generally provide notice and an opportunity to remedy. For serious breaches — including fraud, safety risks, persistent non-compliance, repeated cancellations, or conduct that harms Consumers or the platform — Pitchd may act immediately without prior notice.
If Pitchd terminates your account without cause during a paid subscription period, a pro-rata refund of the unused subscription fee will be issued.
The following obligations survive the termination or expiry of this Agreement: your obligation to fulfil outstanding Confirmed Bookings; your indemnity obligations under this Agreement; intellectual property licences granted to Pitchd; obligations relating to compliance document insurance lapse; and any obligations relating to outstanding disputes, refunds, or chargebacks.
You indemnify and hold harmless Pitchd Holdings Pty Ltd, its directors, officers, employees, and agents against any claims, losses, damages, costs, expenses, and liabilities — including reasonable legal costs — arising directly or indirectly from:
This indemnity is in addition to, and does not limit, any other rights or remedies available to Pitchd under this Agreement or at law. It is directly supported by the warranty and reliance clause at Section 3.6.
To the maximum extent permitted by applicable law, Pitchd's total liability to you arising out of or in connection with this Agreement or your use of the Pitchd platform is limited to the total fees paid by you to Pitchd in the 12 months preceding the event giving rise to the claim.
Pitchd is not liable for indirect, incidental, consequential, or punitive damages; loss of revenue, profit, bookings, data, or opportunity; or losses arising from the actions or omissions of any Consumer. Pitchd is a marketplace intermediary and does not guarantee the behaviour, reliability, or conduct of any Consumer.
Nothing in this Agreement excludes, restricts, or modifies any right or remedy available to you under the Australian Consumer Law.
This Agreement is governed by the laws of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria for any dispute arising in connection with this Agreement.
This Agreement, together with the Terms of Service, Privacy Policy, Cancellation & Refund Policy, Community Standards, Trust & Verification Framework, and all other incorporated policies, constitutes the entire agreement between you and Pitchd in relation to your participation as a Supplier on the Pitchd platform and supersedes all prior representations, agreements, and understandings — including the Payments Terms of Service, which this Agreement now supersedes for all Supplier-facing commercial content.
Pitchd may update this Agreement from time to time to reflect changes to the platform, our business, or applicable law. Suppliers will receive notice of material changes by email and platform notification at least 30 days before the changes take effect. Continued use of the platform after the effective date of a change — including accepting bookings, receiving payouts, or maintaining an active Custom Storefront — constitutes your acceptance of the updated Agreement. If you do not agree with a material change, you may close your account before the effective date in accordance with Section 10.
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force and effect.
Pitchd's failure to enforce any right or provision of this Agreement does not constitute a waiver of that right or provision. A waiver is only effective if made in writing and signed by an authorised representative of Pitchd.
